We process your personal data primarily for purposes related to your use of our website, such as maintaining a user account, placing orders and handling contracts, processing complaints and withdrawals, fulfilling legal tax obligations, sending newsletters, handling claims, analysis, statistics, marketing, etc.
Your personal data is processed for the period necessary to achieve each specific purpose.
You have the right to access your personal data, rectify it, delete it or restrict its processing, object to processing, as well as the right to data portability. In addition, you may lodge a complaint with the President of the Personal Data Protection Office.

# 1: Who is the controller of your personal data?
The controller of your personal data is Krystian Karczyński, conducting business under the name “eTrapez Usługi Edukacyjne E-Learning Krystian Karczyński”, ul. Piaskowa 101 lok. 4, 72-010 Police, NIP: 8512552882, REGON: 812724471.
This Privacy Policy applies to the website https://etrapez.pl along with its subdomains (in particular https://online.etrapez.pl and https://blog.etrapez.pl).
For social media profiles related to our website, according to the case law of the Court of Justice of the European Union, the social network provider is a joint controller of personal data together with the administrator of the given profile. Details on the processing of personal data by social media providers where we have accounts can be found here:

# 2: Who can you contact regarding the processing of your personal data?
As part of implementing data protection in our organization, I decided not to appoint a Data Protection Officer because in our case it is not mandatory.

Regarding social media, you can also contact the administrators of the social media platforms where we maintain our profiles.
# 3: For what purposes do we process personal data?
There is more than one purpose. Below is a list of them, along with more detailed explanations. For each purpose, we have also assigned the appropriate legal basis for processing:

The scope of processed data is described for each purpose above. It includes:

– Anonymous Information.
# 5: What are “Anonymous Information”?
We use tools that collect various information about your use of our website.
This includes, in particular:
– information about your operating system and web browser,
– pages viewed,
– time spent on the site,
– navigation between subpages,
– clicks on individual links,
– mouse movements,
– page scrolling,
– the source from which you entered the site,
– your age range,
– your gender,
– your approximate location limited to the city,
– your interests or other preferences based on online activity,
– video recordings of your sessions on our website,
– heatmaps illustrating your behavior on our pages.
In this Privacy Policy, such data is referred to as “Anonymous Information”.
Anonymous Information, in our opinion, does not constitute personal data because it does not allow us to identify you, nor do we combine it with other personal data that we collect about you.
However, considering strict rulings of the Court of Justice of the European Union and differing legal opinions, out of caution, in case Anonymous Information were deemed personal data, we included detailed explanations about their processing in this Privacy Policy.
We cannot provide you with access to Anonymous Information about you because none of it can be linked to any specific user. From the tools collecting Anonymous Information, we only have access to aggregated statistics and non-identifiable data.
Processing Anonymous Information allows us to provide you with website functionality. Moreover, Anonymous Information is used for analytics, statistics, and marketing purposes such as ad targeting.
Anonymous Information is also processed by tool providers under their terms of service and privacy policies. They may use it to provide and improve their services, manage them, develop new services, measure ad effectiveness, protect against fraud and abuse, and personalize content and ads displayed in various services, websites, and apps.

# 6: Do we share your personal data with ChatGPT?
As part of providing educational services, we use the ChatGPT artificial intelligence model from OpenAI as a feature of the “Virtual Krystian” App. To generate answers to Users’ questions, we send only the text of mathematical queries (e.g., problem statements) to OpenAI, without any personal data or other identifying information, such as IP addresses. We ask Users not to include any personal data in their queries.
OpenAI processes queries sent through its API in accordance with its own privacy policy, available at https://openai.com/policies/privacy-policy/. We recommend reviewing this document to understand how OpenAI processes data.
We take care not to send OpenAI any personal data of Users (e.g., name, surname, email address, IP address) or any information that could identify a specific person. Queries sent to the ChatGPT API are limited exclusively to the content of math problems.
We recommend that when asking questions in the “Virtual Krystian” App, you do not include personal data or other confidential information. If in doubt, Users should phrase their questions in a way that does not identify themselves or third parties.
# 7: Where do we get your personal data from?
In most cases, you provide it to us yourself.
For example, this happens when you register a user account, place an order, submit a complaint or withdraw from a contract, contact us via email or chat, or use features available on our Website or external services (e.g., social media).
Additionally, some information about you may be automatically collected by the tools we use. Detailed information about third-party tools can be found in the section dedicated to the tools we use.
In exceptional cases, we may also obtain your personal data from other sources, e.g., when an entity that employs you provides your data as a contact person for matters related to the concluded contract, or when you represent an entity that enters into a contract with us.
# 8: Are the data secure?
We care about the security of your personal data.
We have analyzed the risks associated with the individual processes of processing your data and then implemented appropriate security and personal data protection measures.
We continuously monitor the state of our technical infrastructure, undergo training, review our procedures, and introduce necessary improvements.
# 9: How long will we keep personal data?
We process your personal data as long as it is justified within the specific purpose of personal data processing. Therefore, processing periods differ depending on the purpose.
Remember that the end of processing your data for one purpose does not necessarily mean the complete deletion or destruction of your personal data, because the same set of data may be processed for another purpose for the period indicated for it. Complete deletion or destruction of the data occurs when we finish all purposes and in other cases specified by GDPR.
Below you will find a description of processing periods:
– User account – data related to the user account is processed as long as the account is active;
– Order fulfillment and concluded contract – data related to the contract is “anonymized” after 6 years (we remove names, surnames, and home addresses);
– Complaints and withdrawals – data related to complaints and withdrawal from a contract is processed for the time necessary to handle the complaint or withdrawal process;
– Newsletter – data related to the newsletter will be processed for as long as you use the newsletter;
– Comments / reviews – data related to posting a comment or review will be processed until you delete the comment or review;
– Contact and correspondence – data related to handling correspondence will be processed for the duration of contact between us;
– Tax and accounting obligations – data related to tax and accounting obligations will be processed for 6 years;
– Backups – data related to backups will be processed until the archived information becomes obsolete;
– Establishment, exercise, and defense of claims – data related to claims will be processed until the expiration of the statute of limitations, which may vary depending on applicable law (e.g., for entrepreneurs it may be 3 years, and for consumers 6 years);
– Ad targeting – data related to ad targeting will be processed until it becomes obsolete or until you effectively object;
– Social media – generally, we have no influence over how long your personal data is stored on social media. They remain available on Facebook, Instagram, YouTube, or TikTok under the terms of those platforms. We cannot delete your data from Facebook, Instagram, YouTube, or TikTok – only you can do that;
– Analytics and statistics – data related to analytics and statistics will be processed until it becomes obsolete or until you effectively object;
– Own marketing – data related to own marketing will be processed until it becomes obsolete or until you effectively object;
– Organization of promotional campaigns – data related to the organization of promotional campaigns is processed for the duration necessary to conduct the campaign;
– Additional tools (video players, widgets) – the additional tools we use provide content from third parties; we have no influence over their processing period and cannot delete it;
– Data protection obligations – data related to data protection obligations will be processed until it becomes obsolete, you effectively object, or the statute of limitations of our responsibility as a data controller expires;
– Security – generally 180 days. Exceptions are situations where our system links it to security threats, e.g., your IP address is placed on a “blacklist”. In such cases, we may store it longer.
If we process your personal data based on your consent, you can withdraw that consent at any time: either by your own action or by contacting us via the provided contact details.
Remember that withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal.
# 10: Who are the recipients of personal data?
We dare to say that modern business cannot function without services provided by third parties. We also use such services. Some of these services involve the processing of your personal data.
External service providers involved in processing your personal data include:
– hosting provider – for storing data on the server, OVH;
– mailing system provider – for using the mailing system, Google (Gmail service) and Freshmail (newsletter service);
– invoicing system provider – for issuing invoices, wfirma;
– cloud computing provider – for storing backups, Google and Microsoft;
– accounting office – for accounting services, Biuro Rachunkowe Hołub;
– providers of IT security tools – to protect against hacker attacks, Google (Google Captcha v3) and OVH;
– other subcontractors, in particular IT solution providers – for cooperation with various subcontractors who may have access to your personal data if they provide services requiring such access.
If necessary, your data may be shared with a legal advisor or attorney bound by professional secrecy. This may result from the need for legal assistance requiring access to your personal data.
Your personal data may also be provided to tax offices to the extent necessary to fulfill tax, accounting, and reporting obligations. This includes all declarations, reports, statements, and other accounting documents containing your personal data.
Additionally, if necessary, your personal data may be made available to entities, authorities, or institutions authorized to access the data under the law, such as the police, security services, courts, prosecutors.
As for Anonymous Information, it is accessed by the providers of tools or plugins that collect Anonymous Information, Google (Google Analytics and YouTube services), Vimeo, and Wolfram Research.
The providers of these tools are independent controllers of the data they collect and may share this data under the terms specified in their own regulations and privacy policies, which we have no influence over.
# 11: Do we transfer data to third countries or international organizations?
Yes, some operations involving the processing of your personal data may require transferring it to third countries (outside the European Economic Area).
We transfer your personal data to third countries in connection with the use of tools utilizing resources located in third countries, particularly in the USA. Providers of these tools guarantee an adequate level of personal data protection through appropriate compliance mechanisms provided for by the GDPR, in particular by using standard contractual clauses.

# 12: Do we use profiling?
We do not make decisions about you based solely on automated processing, including profiling, that would produce legal effects concerning you or similarly significantly affect you.
Yes, we do use tools that may take certain actions depending on the information collected through tracking mechanisms, but we believe these actions do not have a significant impact on you because they do not differentiate your situation as a customer, do not affect the terms of any agreement you may conclude with us, etc.
When using certain tools, we may, for example, show you personalized ads based on your previous actions on the Site or suggest products that may interest you. However, you remain free to decide whether you want to purchase the product recommended to you.
# 13: What are your rights?
The GDPR grants you the following potential rights related to the processing of your personal data:
– the right to access your data and receive a copy of it;
– the right to rectify (correct) your data;
– the right to have your data deleted (if you believe there is no legal basis for us to process your data, you can request that we delete it);
– the right to restrict data processing (you can request that we restrict processing solely to data storage or actions agreed with you if, in your opinion, we have incorrect data or are processing it unlawfully);
– the right to object to data processing (you have the right to object to data processing based on a legitimate interest; you should indicate a specific situation that you believe justifies stopping the processing; we will stop processing your data for these purposes unless we demonstrate that our processing grounds override your rights, or that your data is necessary for establishing, pursuing, or defending claims);
– the right to data portability (you have the right to receive from us, in a structured, commonly used, machine-readable format, the personal data you provided to us based on a contract or your consent; you can instruct us to send this data directly to another entity);
– the right to withdraw consent for processing personal data if you previously gave such consent;
the right to lodge a complaint with a supervisory authority (if you find that we process data unlawfully, you can file a complaint with the President of the Personal Data Protection Office or another competent supervisory authority).

We would like to explain that the above rights are not absolute and will not apply to all processing activities of your personal data.
We emphasize that one of the rights listed above is always available to you: if you believe that we have violated data protection regulations while processing your personal data, you can lodge a complaint with the supervisory authority (the President of the Personal Data Protection Office).

Our website, like almost all other websites, uses cookies.
Cookies are small text files stored on your end device (e.g., computer, tablet, smartphone) that can be read by our IT system (first-party cookies) or IT systems of third parties (third-party cookies).

We use cookies based on your consent, except for situations where cookies are necessary for the proper provision of electronic services to you.
Cookies that are not necessary for the proper provision of services remain blocked until you give your consent to use cookies.

we display a message asking for your consent along with the option to manage cookies, i.e., to decide which cookies you agree to and which you want to block.

Yes, you can manage cookie settings within your web browser.
You can block all or selected cookies. You can also block cookies from specific websites. At any time, you can also delete previously saved cookies and other site and plugin data.
Web browsers also offer the option of using incognito mode. You can use it if you do not want information about visited websites and downloaded files to be saved in browsing and download history. Cookies created in incognito mode are deleted when all windows of this mode are closed.
There are also browser plugins that allow you to control cookies, such as Ghostery. Additional software, particularly antivirus packages, may also provide cookie control options.
Additionally, there are tools available on the Internet that allow you to control certain types of cookies, especially for managing behavioral advertising settings collectively.
We also give you the ability to control cookies directly from our website.
We have implemented a special cookie management mechanism that allows you to block those cookies you do not want.

Yes, we use tools from external providers that collect information about your activities on our websites.

# 20: Do we target ads to you?
On our website, we do not display any targeted ads to you.
However, we advertise on Meta platforms (formerly Facebook) and Google, where we may target ads to you—i.e., ads directed to specific target groups defined based on various criteria such as age, gender, interests, profession, job, or actions previously taken on our websites.

Yes, we may modify this Privacy Policy, in particular due to technological changes and legal regulations.
